2. Applicable Legal Framework

The processing of personal data by KYLVO is governed by Law No. 19,628 on the Protection of Private Life and by Law No. 21,719 on Personal Data Protection, published in the Official Gazette on December 13, 2024, and fully effective as of December 1, 2026, which modernizes Chile’s regulatory framework and aligns it with international standards such as the European GDPR.

KYLVO is committed to adapting its data processing practices to the requirements of Law No. 21,719 within the deadlines established by that regulation.

3. Data We Collect

Through the contact form available on this site, KYLVO collects the following personal data:

  • First and last name
  • Region and municipality (comuna)
  • Contact email address
  • Mobile phone number (optional)
  • Company name (optional)
  • Message submitted by the user

No sensitive personal data is collected within the meaning of applicable legislation. The submission of optional fields is entirely at the user’s discretion.

4. Purpose of Processing

The personal data collected is used exclusively for the following purposes:

  • To respond to technical or commercial inquiries submitted through the contact form.
  • To route the inquiry to the regional sales representative covering the user’s area.
  • To improve the quality of service provided by KYLVO to its users.

KYLVO will not use the data for purposes other than those stated above without the prior consent of the data subject.

5. Legal Basis for Processing

The processing of personal data is based on the free, informed, and voluntary consent of the user, who accepts this Privacy Policy by completing and submitting the contact form. Consent may be withdrawn at any time, without affecting the lawfulness of processing carried out prior to its withdrawal.

6. Sharing of Data with Third Parties and International Transfers

KYLVO does not sell, transfer, or share users’ personal data with third parties, except in the following cases:

  • When required by law to disclose data to competent authorities, including the Personal Data Protection Agency (APDP).
  • When necessary to route the inquiry to the corresponding regional representative within KYLVO’s own organization.

This website may use third-party services located outside Chile, such as web analytics tools (e.g., Google Analytics) or digital infrastructure platforms. In such cases, data may be processed on servers located abroad, subject to each provider’s own security and privacy conditions. KYLVO endeavors to work only with providers that offer adequate data protection guarantees in accordance with applicable regulations.

Under no circumstances will data be used for advertising purposes by third parties.

7. Retention Period

Personal data will be retained for as long as necessary to respond to the submitted inquiry and, thereafter, for the period required by applicable law or reasonably necessary to handle any follow-up queries or claims arising from that interaction.

Once the purpose has been fulfilled, data will be securely deleted or anonymized.

8. Rights of the Data Subject

Under Law No. 19,628 and Law No. 21,719, users have the right to:

  • Access their personal data held by KYLVO.
  • Request the correction of inaccurate or outdated data.
  • Request the deletion or cancellation of their data when it is no longer needed for the purpose for which it was collected.
  • Object to the processing of their data in cases provided for by law.
  • Request the portability of their data, meaning the right to receive it in a structured, commonly used format and to transfer it to another controller where technically feasible.

To exercise any of these rights, the user may send a written request to contacto@kylvo.cl, stating their full name, the right they wish to exercise, and, if applicable, the specific data to which the request relates. KYLVO will respond within a maximum of 15 business days for access requests and 30 business days for other requests, in accordance with applicable regulations.

When the breach entails a high risk for the affected data subjects, they will be notified directly and without undue delay.

However, KYLVO cannot guarantee the absolute security of information transmitted over the internet. Users accept this risk when submitting the contact form.

11. Changes to This Policy

KYLVO reserves the right to update this Privacy Policy at any time, in particular to reflect regulatory changes, including the full entry into force of Law No. 21,719. Any changes will be published on this page with the updated effective date and will take effect upon publication.

Users are encouraged to review this page periodically to stay informed about how KYLVO protects their information.

12. Governing Law

This Privacy Policy is governed by Law No. 19,628 on the Protection of Private Life and Law No. 21,719 on Personal Data Protection, both of the Republic of Chile. Any disputes arising from its application shall be submitted to the Ordinary Courts of Justice of Santiago, without prejudice to the powers of the Personal Data Protection Agency (APDP).
