1. Identification and Scope<\/h2>\n\n\n\n

These Terms and Conditions govern access to and use of the KYLVO SpA website (hereinafter KYLVO), a company incorporated under the laws of the Republic of Chile, with registered address at Av. Vitacura 5250, Office 601, Vitacura, Santiago. <\/p>\n\n\n\n

By accessing, browsing, or using any content on this site, the user fully accepts these Terms and Conditions. If you do not agree with any of the provisions herein, you must refrain from using this site. <\/p>\n\n\n\n

KYLVO reserves the right to modify these terms at any time. Changes will be published on this page with the updated effective date and will take effect upon publication. <\/p>\n\n\n\n

2. Use of the Site<\/h2>\n\n\n\n

This site is informational in nature and is intended for agricultural distributors, plant nurseries, and professionals in the horticultural sector. It is not intended for end consumers. <\/p>\n\n\n\n

The user agrees to use the site and its contents lawfully, refraining from any activity that may damage, disable, overload, or impair the site or its systems, or that may infringe the rights of KYLVO or third parties.<\/p>\n\n\n\n

The use of robots, scrapers, or other automated means to access, extract, or reproduce the contents of the site without prior written authorization from KYLVO is expressly prohibited.<\/p>\n\n\n\n

3. Sales Channel and Commercial Model<\/h2>\n\n\n\n

KYLVO SpA sells its products exclusively through authorized agricultural distributors. This website does not constitute a direct sales channel to the public or to farmers, and does not publish retail prices. Current pricing is communicated to distributors through the official price list issued periodically by KYLVO. <\/p>\n\n\n\n

To place orders, distributors must send a Purchase Order to the corresponding regional representative, with a copy to contacto@kylvo.cl. The Purchase Order must indicate the required shipping method and specify whether shipping insurance is requested. <\/p>\n\n\n\n

Shipping costs and insurance, if requested, are not included in the product price and are the exclusive responsibility of the distributor.<\/p>\n\n\n\n

Commercial conditions, discounts, and payment terms are determined by KYLVO’s Sales Department and governed by the agreements in force with each distributor.<\/p>\n\n\n\n

4. Product and Variety Information<\/h2>\n\n\n\n

Products and varieties presented on this site are for informational purposes only. KYLVO does not publish prices on its website; current pricing is communicated exclusively through the official price list, which supersedes all previous versions and is available to authorized distributors. <\/p>\n\n\n\n

KYLVO reserves the right to modify its product portfolio, variety availability, and sales conditions without prior notice.<\/p>\n\n\n\n

Shipments are at the distributor’s expense and risk. Loss or damage of parcels in transit is the distributor’s responsibility, unless shipping insurance has been expressly contracted. Once dispatched, returns are not accepted. <\/p>\n\n\n\n

The distributor has 5 business days from receipt of the shipment to report any irregularity to the corresponding regional representative, with a copy to contacto@kylvo.cl. After this period, KYLVO will not assume any liability. <\/p>\n\n\n\n

5. Technical and Agronomic Information<\/h2>\n\n\n\n

All technical information published on this site \u2014 including variety data sheets, planting recommendations, crop calendars, estimated yields, and trial results \u2014 derives from field evaluations and is strictly for reference purposes.<\/p>\n\n\n\n

Results may vary significantly depending on geographic zone, seasonal weather conditions, agronomic practices, soil quality, and other factors outside KYLVO’s control.<\/p>\n\n\n\n

This information does not constitute a guarantee, promise of results, obligation, or liability of any nature for KYLVO SpA. It should not be interpreted as specific agronomic advice for any particular farming operation. <\/p>\n\n\n\n

It is the responsibility of the distributor and the end user to evaluate, based on available technical data and their own knowledge and growing conditions, whether varieties are suitable for their timing, region, and production system.<\/p>\n\n\n\n

6. Intellectual Property<\/h2>\n\n\n\n

All content on this site \u2014 including texts, images, photographs, logos, icons, graphic designs, trademarks, variety names, and other elements \u2014 is the property of KYLVO SpA or its suppliers, and is protected by Law No. 17,336 on Intellectual Property and other applicable regulations.<\/p>\n\n\n\n

Reproduction, distribution, transmission, modification, adaptation, or use of any content from this site for commercial purposes, without prior written authorization from KYLVO, is expressly prohibited.<\/p>\n\n\n\n

Variety names, trademarks, and technical designations mentioned belong to their respective owners. Their mention on this site does not imply any transfer of rights or license for use. <\/p>\n\n\n\n

The use of metatags, hidden text, or other technical resources incorporating KYLVO’s brands or names without prior authorization is prohibited.<\/p>\n\n\n\n

7. Limitation of Liability<\/h2>\n\n\n\n

KYLVO shall not be liable for crop losses, loss of profits, consequential damages, or any other indirect loss arising from the use of its products. <\/p>\n\n\n\n

8. Personal Data Protection and Privacy<\/h2>\n\n\n\n

Personal data provided by the user through contact forms or other means on this site is processed in accordance with Law No. 19,628 on the Protection of Private Life and its amendments.<\/p>\n\n\n\n

Data collected will be used exclusively for commercial, communication, and service improvement purposes by KYLVO, and will not be shared with third parties without the data subject’s consent, except as required by law.<\/p>\n\n\n\n
